PRODUCT LIABILITY / DEFECTIVE PRODUCTS

When a product manufacturer is negligent and that negligence causes an injury, it is a products liability case.

When a product is put on the market, its designer, maker, distributor, etc. warrants that it is reasonably safe for its intended uses.  A plaintiff must show that 1) the product was unreasonably dangerous either for the product's intended use or for some other reasonably foreseeable use, and 2) that the unreasonably dangerous condition existed when the product left the defendant's hands.

Carmichael Ellis & Brock, PLLC represents persons injured by:

  • negligent design / defective design
  • defective manufacturing process
  • no warning label
  • error-filled warning label
  • insufficient guarding
  • lawnmower rollover
  • brain and spinal cord injuries

If you have been injured by a defective product make sure that you or someone on your behalf take whatever steps are necessary to preserve it.  Put it in a safe, secure place and ensure that it remains in the condition that it was found.  Call our experienced lawyers right away to help you find expert engineers or other specialists who can come do a site inspection, take measurements and take those steps necessary to form an opinion on the cause of your injuries.

PERSONAL INJURY

Personal injury cases are a type of tort lawsuit where an injured party sues for the wrongful act of another. The wrongful act could be something done intentionally (assault, battery, defamation) or negligently. The vast majority of cases involve someone's negligence.

Negligence happens when a person fails to behave reasonably, or falls short of a duty of care they owe to another, thereby causing injury to the other person. A person is injured when their body and/or mind is hurt, and could include a person's death.

Carmichael Ellis & Brock, PLLC, represents injured persons in the following types of negligence cases:

  • automobile accidents
  • truck accidents
  • tractor-trailer accidents
  • pedestrian accidents
  • motorcycle accidents
  • medical malpractice
  • wrongful death
  • products liability/defective products
  • traumatic brain and spinal cord injuries

If you have suffered an injury because of the actions of another, you may be able to recover damages to compensate you for your injuries, your lost income, your lost quality of life, etc. The most important thing for you to do after you suffer an injury caused by another is to follow your physician's advice and take the steps necessary to get better. Take pictures of your injuries and your recovery. Keep track of when you attend your various doctors appointments and what medical bills you have received. Taking these steps will help your attorney make sure that you receive full compensation for each item of damage you can claim.

Personal injury cases are controlled by a strict statute of limitations; this means you must file your case within a certain time frame or your case is lost. In most personal injury cases in Virginia, that time is two years from the date you suffered the injury within which to bring a lawsuit. But some cases have a shorter or longer statute of limitations. Do not delay – if you or someone you love has been injured because a driver, a doctor or someone else failed to live up to their duty of care, call our experienced and tenacious lawyers today.

MEDICAL MALPRACTICE

In medical malpractice cases, a patient has been injured because their doctor was negligent. A doctor is negligent when he treats or fails to treat his patient in a way that a reasonably, prudent physician in the same or similar field would treat the patient, thereby causing injury to the patient.

Doctors occasionally fail to diagnose cancer, appendicitis or an aortic aneurysm.  Doctors, pharmacies and nurses occasionally make medication errors. But not every negative outcome is caused by medical negligence. Patients die or get hurt even when they receive the best care. It is therefore important to seek counsel to help you find resources and investigate your potential medical malpractice claim.

If you suspect that your injury may be caused by a doctor or hospital's negligence, call our experienced lawyers for a consultation so we can help you investigate your claim.

Carmichael Ellis & Brock, PLLC, represents patients injured by:

  • failure to diagnose / misdiagnosis
  • hospital errors
  • nursing home errors, falls, abuse
  • surgical errors
  • medication errors

PLEASE NOTE: Each case has different circumstances and therefore past results do not guarantee future outcomes. Although this is advice provided by a lawyer, it should not be considered legal advice. There is no attorney-client relationship until retainer agreement signed by client and lawyer.
